Chapter 61 Bill Takes Effect Jan. 1, 2001

The new law completely rewriting Chapter 61 of the Kansas statutes, which was passed by the 2000 legislature, takes effect on January 1, 2001.  As clerks, judges and lawyers alike struggle through this new law, it will be a lot like a space odyssey.  (2001; get it?)

Chapter 61 Forms approved by Sup. Ct.

A big part of the changes to Chapter 61 are new forms for use under Chapter 61.  The forms were drafted by the Kansas Judicial Council.  Much of the substance of the new law is contained in the forms and the instructions which accompany some of them.

The Kansas Supreme Court approved the forms by Order entered the week of December 18, 2000.

The Dark Side of the Forms

I like to throw in a lot of sci-fi movie metaphors.  The good in the new forms is that they will over time simplify things for clerks, judges and attorneys.  The dark side is that everyone must get new forms ready to use.  For clerks, that means printing a whole new set of forms.  For attorneys, that means reprogramming their computers.
