The Jucicial Council of Kansas approved for introduction to the year 2000 legislature, a proposed amendment to Chapter 61 of the Kansas Statutes Annotated. The proposed amendment consists of: (1) a complete rewrite of Chapter 61 which if adopted will repeal the existing Chapter 61 and replace it with a new code of civil procedure for limited actions; (2) a proposed supreme court rule for technical standards for electronic filing of court documents; and (3) a proposed supreme court rule that will contain forms for practice under Chapter 61 to be drafted if and when the new act is passed.Chapter 61 is the Code of Civil Procedure for Limited Actions and governs most collection cases filed in Kansas. The proposed amendment generally will allow for electronic filing of court cases throughout the state, streamline serveral procedures under Chapter 61 and reduce or eliminate paper to be filed wherever possible. For a more detailed summary
of the proposed amendment as well as the full text of the amendment with
comments, go to www.kcaa.net. I
am a member of the subcommitte of the Judicial Council which drafted
the proposed amendment.
For
a general summary of this topic, see the section on electronic
filing elsewhere on this web site. The Civil Practice Committee
of the Wichita Bar Association is studying recommendations that the Bar
Association can make to help bring about electronic filing in Sedgwick
County. I am a member of the Civil Practice Committee and am the
chair of the subcommittee that is studying the issue.
We
are almost done with the programming to allow e-mail to be sent to clients
directly from my collection system software. We will start testing
soon. I expect to have this in place by the end of the year.
